《Notes to Passengers》

一、Basic Clauses

  1. Passengers who choose to take or rent any cross-boundary vehicles (including coach, bus or car) under China Travel Service (Hong Kong) Limited or its agents or/and any transfer vehicles halfway travelling from Hong Kong to the Chinese mainland shall understand and agree to abide by the Notes to Passengers。
  2. The ticket sales agents can sell the ticket directly to the passengers. The ticket sales agents or China Travel Service (Hong Kong) Limited is not the actual carrier. The actual carrier is the vehicle operator (subject to the operating vehicle registration). Passengers can ask for the name of the actual carrier before boarding。
  3. The Notes to Passengers is the basic clause of the Passenger Transport Contract entered into by and between the actual carrier and the passengers. Please carefully read all the contents of the Notes to Passengers and the terms and conditions on the back of the ticket before buying the ticket. After a passenger pays for the ticket, it shall be deemed as the passenger has accepted the Notes to Passengers。
  4. When a passenger (including the heirs thereof) claims rights to the actual carrier or the agent (China Travel Service (Hong Kong) Limited) based on the Road Transport Contract or due to any infringement, he/she should choose the Shenzhen Arbitration Commission to resolve the dispute through arbitration and the laws of the People’s Republic of China shall apply。

二、Rules of Riding

  1. All tickets are valid only on the day and for the shuttle No. indicated on the tickets. Passengers are required to keep their tickets for inspection. In case of lost, the passenger must re-purchase the ticket. The ticket shall become invalid once altered. Passengers must arrive at the pick-up point 15 minutes before the departure time according to the shuttle No. indicated on the ticket. You can get on the bus with your ticket. Passengers shall present the physical ticket when boarding。
  2. One ticket for one passenger. A child aged 0-3 are required to buy a nominal ticket (for Disney route only); a child aged 3 or older is required to by a child ticket, and a 6 years or older child shall buy an adult ticket (for some routes, child ticket is for 3-12 years old; and no child ticket or elderly ticket is available in some other routes). It is recommended that minors should be accompanied by guardians when travelling in our vehicles. For the safety of passengers and compliance with traffic regulations, when the bus has reached the authorized carrying capacity (including those with free tickets and who do not occupy seats), the carrier driver has the right to refuse further boarding, and the passengers who are refused to board the bus can apply for a full refund of the tickets。
  3. Before purchasing the ticket, the purchaser should ensure he/she holds a valid document. According to the relevant traffic rules of the Government, the carrier has the right to require passengers to present valid documents and visas before boarding. If the passenger fails to present any valid documents and visas, the carrier has the right to refuse to take the passenger without refunding the ticket。
  4. In order to avoid delays of other passengers due to some individual passengers’ customs clearance procedures, the cross-boundary bus will wait only a maximum of 15 minutes for passengers. If the delay of individual passengers is caused by the inspection by the border control, immigration, customs, health and quarantine departments of China and Hong Kong, the delayed passengers may be transferred to other shuttles of the carrier's subsidiaries or use other means of transportation at their own expense. The carrier is not liable for this。
  5. The carrier of a cross-boundary bus has the right to require passengers to transfer to other vehicle(s) depending on the port conditions. A cross-boundary shuttle bus is not necessarily a non-stop bus that reaches the destination directly. The carrier has the right to arrange pick-up and drop-off points, interim stops and transfer service according to the schedule, passengers and transport capacity dispatch, so as to shorten the time that passengers waits at the port。

三、 Regulations on Luggage

  1. Each passenger can only carry one small piece of luggage and one large piece of luggage. The large luggage should be placed in the luggage compartment as required by the carrier. The maximum luggage size is 56cm×36cm×22cm. If a passenger carries more luggage than the aforementioned limit, the carrier has the right to require the passenger to purchase an additional luggage ticket accordingly. The carrier has the right to prohibit passengers from carrying any overweight, oversized, extra-long articles or any other articles that the carrier deems to be unsuitable for boarding, and the concerned passengers will not be refunded 。
  2. According to the relevant regulations of the governments of the Chinese mainland and Hong Kong, passengers are not allowed to carry any flammable, explosive, smuggled articles or any articles prohibited by the customs of the two sides. The carrier’s driver has the right to refuse to permit passengers carrying any prohibited articles. If any accident is caused by a passenger/passengers carrying any prohibited articles, all consequences and the carrier's all economic losses caused thereby shall be borne by such passenger(s)。
  3. Passengers should take care of their belongings when the bus stops or during boarding and alighting. Passengers are solely responsible for all risks associated with their belongings. The carrier shall not be liable for any loss or damage of passengers’ belongings, unless it's proved that such loss or damage is caused by the carrier。
  4. Passengers should carry around their articles of high value or commemorative significance, and never place such articles in the luggage compartment of bus. All articles placed in the luggage compartment of the bus are treated as checked luggage. If it is proved that any checked luggage is damaged or lost due to the carrier’s fault, the carrier shall pay compensation at the amount up to HK$500 for each piece of such damaged or lost luggage 。

四、Miscellaneous

  1. For the safety and health of all passengers, the carrier will refuse to permit any passenger who is found (or considered by the carrier) to be intoxicated, or found to be a patient suffering from infectious disease or serious illness or a pregnant woman who is about to give birth. Passengers who have been refused may apply for ticket cancellation within three working days from the day of being refused。
  2. After boarding the bus, do not eat or drink, and do not talk loudly or disturb others. Use earphones when using any electronics that can make a sound. Do not talk to the driver or leave the seat while driving. The carrier has the right to request passengers who violate the above regulations to get off the bus or refuse to permit the aforementioned passengers, and such passengers will not be refunded。
  3. Passengers are required to obey the instructions of the carrier’s driver or staff members on duty, and board on and alight from the bus at the locations specified according to the actual condition, and they may not request for boarding or alighting at any locations other than the specified ones along the way。
  4. The carrier shall not be liable if the passenger fails to make the scheduled itinerary due to delays in entry and exit formalities handling, road conditions, traffic accident or any other reason that lead to delays in departure and/or driving and/or arrival of the bus. Passengers who choose the carrier should select appropriate shuttle schedule by themselves and budget enough time for customs clearance and delays in transportation. The carrier shall not be liable for passengers’ delay。
  5. If the carrier believes that the bus cannot be safely driven due to the No. 8 Gale or Storm Signal, Black Rainstorm Warning Signal or other weather reasons, the carrier has the right to cancel the shuttle schedule at its discretion. It is recommended that passengers call the Customer Service Center or visit the company’s WeChat official account (WeChat account: HKCTSBUS) to inquire the shuttle schedule. If the shuttle schedule is canceled due to bad weather, the passenger may apply for ticket cancellation within 7 working days from the scheduled departure date or change the ticket for the same route within three months. Passengers who purchased tickets on the WeChat platform may apply for ticket cancellation or change their tickets directly on the same platform. The carrier shall not be liable for any inconvenience or loss to passengers caused by the No. 8 Gale or Storm Signal, Black Rainstorm Warning Signal or other weather reasons。
  6. In the event of a bus failure, the carrier may arrange another bus instead. If the carrier fails to do so, passengers may change to other means of transportation. The passenger may apply for ticket cancellation within 7 working days from the scheduled departure date or change the ticket for the same route within three months. Passengers who purchased tickets on the WeChat platform may apply for ticket cancellation or change their tickets directly on the same platform. The passenger agrees that the carrier is not liable for any loss caused by the delay of the bus。
  7. The carrier’s buses in operation are insured by the third-party liability insurance purchased in Hong Kong and the Chinese mainland as required. However, the carrier encourages passengers to purchase additional traffic accident commercial insurance. If a bus has a traffic accident in the Chinese mainland, the injured passengers must stay at the scene and wait for the local public security and traffic police to handle, record and inspect the injuries at the scene of the accident before leaving the scene or the Chinese mainland. If any passenger leaves the scene or the Chinese mainland without authorization or fails to have his/her accident recorded by police station at the scene, the carrier is not liable for the case that the passenger’s insurance claim is rejected due to lack of indemnity basis. The passenger also agrees to waive the right to claim indemnity for any traffic accident occurring in the Chinese mainland with Hong Kong courts or with the Small Claims Tribunal. For traffic accidents that occur in the Chinese mainland and cause injuries or deaths of passengers, the maximum amount of indemnity is RMB ONE HUNDRED THOUSAND YUAN ONLY per passenger according to the regulations of the Chinese mainland。
  8. The Notes to Passengers is an annex to the terms printed on the back of the ticket (i.e. the Ticket Terms). For matters not covered by the Ticket Terms, the Notes to Passengers shall prevail. If there is any inconsistency between the Ticket Terms and the Notes for Passengers, the Ticket Terms shall prevail. If there is any inconsistency between the Chinese and English versions of the Notes for Passengers, the Chinese version shall prevail。
  9. For details of the policy on normal ticket change/cancellation, please refer to the change/cancellation policy on the website (http://www.hkctsbus.com) or the WeChat platform (WeChat account: hkctsbus) 。
  10. The Notes for Passengers is posted on the bulletin board at the ticket office. Passengers also can visit the company’s website and the WeChat platform, or call the Customer Service Centre to get information about the Notes for Passengers。
